The first step is appointing a Trustee to start a Wrongful Death Claim. According to Minnesota law, a Trustee must be appointed by the court. Often times, the surviving spouse or other relative is appointed and the court will allow them to serve as Trustee without bond. The Trustee is the individual who will sign a retainer agreement with an attorney, and cooperate with the investigation. This can include signing medical authorizations, gathering police accident reports and hospital records, death certificates and coroner’s reports. We may also consult with medical experts, accident reconstructionists, and economists when working on the case. For these reasons, the Trustee should be someone that the heirs believe to be competent and trustworthy.
