Jury Instructions
When a case goes to trial, it is typically up to a jury to determine what damages are compensable. A jury measures the damages in a Wrongful Death Lawsuit using several criteria. Some examples of the criteria that they take into consideration are as follows:
- contributions in the past
- life expectancy
- health, age, habits, talents, and success
- occupation
- past earnings
- likely future earning capacity and prospects of bettering themselves
- personal living expenses (like cost of supporting a child)
- legal obligation to support a surviving spouse or next of kin
- reasonable expenses incurred for a funeral and burial
- reasonable expenses for support due to last sickness, necessary medical and hospital expenses
- counsel, guidance, and aid they would have given
- advice, comfort, assistance, companionship, and protection they would have given
- lost time together
